Conveyancing Forms



The process of conveyancing involves the completion of various forms. Some of these forms, are accessible via the links below to the Department of Lands. For more information, please contact us or the Department of Lands (www.lands.nsw.gov.au).


 

Annulment of Bankruptcy (PDF 126.0 kb)

Used to register the bankrupt or other entitled party as registered proprietor on annulment of the bankruptcy pursuant to s90 Real Property Act 1900.

 

Application for Replacement Certificate of Title (PDF 15.7 kb)

Used to apply for a new Certificate of Title due to loss or destruction of the current version pursuant to s38(2) & s111 Real Property Act 1900.

 

Application for Possessory Title (PDF 113.5 kb)

Used to apply for registration as proprietor of Torrens Title land based on adequate proof of possession pursuant to s45D Real Property Act 1900.

Used for the removal of a Caution from a Qualified Title pursuant to s28M or s28MA Real Property Act 1900.

 

Caveat (PDF 134.5 kb)

An instrument recorded on a folio of the Register legally prohibiting the registration of certain dealings or transactions affecting land or forbidding certain actions pending judicial determination pursuant to s74F Real Property Act 1900.

 

Caveat Affecting a Primary Application (PDF 126.4 kb)

An instrument used to prevent the Registrar General from proceeding with a Primary Application pursuant to s74B Real Property Act 1900.

 

Change of By-Laws (PDF 84.4 kb)

Used for amendment, addition or repeal of by-laws affecting the common property of a Strata scheme pursuant to s48(2) Strata Schemes Management Act 1996.

 

Charge (PDF 82.9 kb)

Used to secure the payment of an annuity, rent-charge or sum of money other than a debt pursuant to s56(2) Real Property Act 1900.

Used by the lessor to serve notice under s91(2) Real Property Act 1900 on any person who has, or claims to be entitled to, an interest in that lease, where the lessee has been declared bankrupt and the trustee for the lessee has disclaimed the lease.

 

Notice by Mortgagee (PDF 98.4 kb)

Used by a mortgagee of the lease to serve notice under s91(5) Real Property Act 1900 on any person who has, or claims to be entitled to, an interest in that lease, where the lessee has been declared bankrupt and the trustee for the lessee has disclaimed the lease.

Used for a resumption of common law land or an easement involving common law land by a prescribed authority pursuant to s31A(2) Real Property Act 1900.

Used to change the registered proprietor and/or tenancy/shares usually following a sale of the land.

 

Transfer and Road Closure (PDF 102.5 kb)

A transfer by the State of New South Wales to an adjoining owner of the site of a closed road.

 

Transfer by a Local Council (PDF 91.9 kb)

Used for a transfer of Torrens Title land by a Local Council for unpaid rates pursuant to s713 Local Government Act 1993.

 

Transfer for Public Reserve or Drainage Reserve (PDF 381.9 kb)

A transfer of land to a Local Council pursuant to s49 Local Government Act 1993 for a public reserve or a drainage reserve.

 

Transfer Granting Easement etc Over Own Land (PDF 92.2 KB)

Transfer pursuant to s46A Real Property Act 1900 used to create an easement, restriction on the use of land, profit ? prendre or forestry right where both the servient and the dominant tenements have the same registered proprietor. May be used in place of an instrument pursuant to s88B Conveyancing Act 1919.

Used for a transfer of Torrens Title land and the recording of a covenant between the transferor and the transferee.

 

Transfer Including Easement (PDF 106.9 kb)

Used for a transfer of Torrens Title land and the creation of an easement involving that land.

 

Transfer of a Profit ? Prendre or Forestry Right (PDF 83.4 kb)

Used for a transfer by the party benefiting from a registered profit ? prendre or forestry right that does not have a dominant tenement pursuant to s87A or s88AA Conveyancing Act 1919.

 

Transfer of Lease, Mortgage or Charge (PDF 101.4 kb)

Used for a transfer of a registered lease, mortgage or charge by the lessee, mortgagee or chargee.

 

Transfer Under Power of Sale (PDF 92.6 kb)

Used for a transfer by the mortgagee pursuant to a power of sale in a registered mortgage. See s58 Real Property Act 1900.

 

Transfer Unilaterally Severing Joint Tenancy (PDF 111.6 kb)

Used where a joint tenant alone severs the joint tenancy in order to hold as a tenant in common in shares equivalent to the interest held as joint tenant. See s97 Real Property Act 1900.

 

Transfer Without Monetary Consideration (PDF 103.4 kb)

Used where a joint tenant alone severs the joint tenancy in order to hold as a tenant in common in shares equivalent to the interest held as joint tenant. See s97 Real Property Act 1900.

 

Transmission Application (PDF 90.9 kb)

Used to register the executor, administrator, trustee, beneficiary, devisee or next-of-kin of a deceased registered proprietor who holds solely or as a tenant in common pursuant to s93 Real Property Act 1900.
